By accessing or using Swer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Swer provides creator tools including a dashboard for managing content, analytics, a browser extension for workflow productivity, and a creator connections marketplace. The Service is available via web application and browser extension.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use

You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Upload or transmit viruses, malware, or any other malicious code
• Impersonate any person or entity, or misrepresent your affiliation
• Scrape, crawl, or use automated means to access the Service without permission
• Use the Service to harass, abuse, or harm another person

5. User Content

You retain ownership of any content you upload or create through the Service ("User Content"). By uploading User Content, you grant Swer a limited licence to store, display, and distribute that content solely for the purpose of providing the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and share it.

6. Profile Pages

Swer provides customisable profile pages accessible via a public URL. You are responsible for all content displayed on your profile page. We reserve the right to remove or disable any profile page that violates these Terms.

7. Browser Extension

The Swer browser extension ("Copilot") enhances your workflow by providing productivity tools across websites. The extension:

• Only accesses data necessary for its stated features
• Stores data locally on your device and synced to your Swer account
• Does not collect browsing history or personal data beyond what is required for functionality

8. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing:

• You authorise us to charge the payment method on file on a recurring basis
• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time; access continues until the end of the current billing period
• Refunds are provided at our discretion

9. Third-Party Integrations

The Service integrates with third-party platforms (e.g. social media networks). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the actions or policies of any third-party service.

10. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Swer and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings. Upon termination, your data will be permanently deleted.

12. Limitation of Liability

The Service is provided "as is" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Swer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
